Representative Matters

• Represented a Fortune 100 pharmaceutical company in a plaintiff’s appeal of a district court’s denial of plaintiff’s claims for lost profits and incidental damages under the Uniform Commercial Code. United States Court of Appeals for the Seventh Circuit affirmed the summary judgment rulings in our client’s favor.

• Represented a Fortune 100 diversified manufacturing company in a complex product liability and breach of contract case where plaintiffs appealed from a low damages award. Successfully preserved the jury’s low damages award in Illinois Appellate Court.

• Represented a Chicago-based professional liability insurer in an insured’s appeal to the U.S. Court of Appeals for the Seventh Circuit. Successfully preserved judgment of “no coverage” in the $10 million insurance coverage dispute when, after briefing and on the eve of oral argument, the insured agreed to abandon its appeal for a nominal settlement.

• Appealed a state court judgment of $25 million on behalf of a cable television pioneer and affiliated companies in a case involving breach of fiduciary duty and related claims arising out of client’s role as general partner in various cable television limited partnerships. The Illinois Appellate Court reversed judgment in its entirety and affirmed the trial court’s directed verdict in our client’s favor on issue of punitive damages.
